Convalescence leave for working women after giving birth

Updated 25 Oct 2026

Under Article 41 of the 2014 Law on Social Insurance, a female employee who, right after her maternity leave, has not yet recovered her health within the first 30 days back at work is entitled to 05 to 10 days of convalescence and health recovery leave.

Note: the first 30 days back at work are counted from the day the maternity benefit period ends while the employee's health has not yet recovered.

The exact number of days off is decided by the employer and the grassroots trade union executive committee, up to the following maximums:

  • Up to 10 days for female employees who give birth to two or more children at once;
  • Up to 07 days for female employees who give birth by caesarean section;
  • Up to 05 days in other cases.

Note: This period includes public holidays, Tet holidays and weekly days off.

During this time, the employee receives the post-maternity convalescence and health recovery benefit at the following rate:

Daily benefit = 30% x Base salary

From 01/7/2023, the base salary is 1.8 million VND (under Decree 24/2023/ND-CP). So the postnatal convalescence benefit is 540,000 VND/day.

These regulations show that the law gives employees the greatest possible support to fulfil their role as parents. So couples having a baby should pay special attention to their maternity benefits!
