Eligibility for maternity and unemployment insurance benefits if you quit your job right after maternity leave

For maternity benefits: under Article 31 of the 2014 Law on Social Insurance, the conditions for receiving maternity benefits after giving birth are:

• You must have paid social insurance for at least 6 months within the 12 months before giving birth
• You can still receive maternity benefits with less than 6 months of social insurance contributions only if you took leave from work to rest during pregnancy on a doctor's orders. In that case, the condition is: you only need to have paid social insurance for at least 3 months within the 12 months before giving birth, and have participated in social insurance for at least 12 months in total, which need not be continuous.

As for unemployment insurance, Article 49 of the 2013 Law on Employment states that a female employee who quits her job right after maternity leave can still receive unemployment insurance if she meets the following conditions:

• You paid unemployment insurance in the month immediately before your maternity leave
• You have terminated your contract, except in cases of unilateral termination in breach of the law or when receiving a retirement pension
• You have paid unemployment insurance for at least 12 months within the 24 months before leaving your job
• You have submitted your application for unemployment benefit at an employment service centre within 3 months from the date your contract ended.
• You have not found a job 15 days after submitting your application for unemployment benefit.

So you can fully receive both maternity and unemployment insurance benefits if you meet the respective conditions for each benefit set out above.
