Paternity leave for fathers when their wife gives birth
Updated 25 Oct 2026
Under the regulations, when a wife gives birth and her husband pays into Social Insurance, the husband is entitled to paternity benefits: he can take leave from work at his company and still receive full pay. Under Clause 2, Article 34 of the 2014 Law on Social Insurance, a husband whose wife gives birth is entitled to the following leave:
- 05 working days for a normal (vaginal) birth of 1 baby;
- 07 working days if the wife has a caesarean section or gives birth before 32 weeks;
- 10 working days for twins; from triplets onwards, an extra 3 working days for each additional baby, up to a maximum of 14 working days;
- 14 working days if the wife gives birth to twins or more by caesarean section;
Note:
- The number of leave days includes public holidays, Tet and weekends.
- A male employee's leave must be taken within 30 days from the date his wife gives birth.
- If a male employee takes leave before his wife gives birth, those days count as annual leave or unpaid leave and are not paid as paternity benefits.
